EPA Issues Title V Flexible Permits Proposal

Beveridge & Diamond, P.C., August 30, 2007

US EPA has made available a pre-publication copy of a proposal to allow Title V facilities to obtain "flexible air permits" that would provide advance approval for different operating scenarios. The concept is that a flexible air permit would describe current operational plans and possible changes to those plans for the 5 year permit term, and would include permit conditions to address those alternative scenarios.

According to EPA's fact sheet on the proposal, flexible air permits would encourage pollution prevention; provide increased flexibility, enable industrial facilities to make rapid changes to respond to market demands; save resources for state permitting authorities, and improve public information.
