EPA Warns That TSCA IUR Submissions Should Not Be Submitted Via U.S. Mail

Beveridge & Diamond, P.C., November 16, 2006

Chemical manufacturers and importers subject to Inventory Update Reporting (“IUR”)  under the Toxics Substances Control Act are being warned by EPA that IUR submissions coming into the Agency via U.S. mail are routinely damaged due to governmental irradiation procedures.  Irradiation can harm both paper copies and CD-ROM submissions.  For that reason, EPA is requesting that reporting companies either:  (1) send their IUR submission via the Internet using EPA’s Central Data Exchange (“CDX”), or (2) use a hand delivery service instead of regular U.S. Mail.  A link to CDX, and instructions for its use, and an address for hand delivery are available at http://www.epa.gov/oppt/iur/pubs/guidance/deadlines.htm.  EPA’s announcement is available by clicking here.  More information about government radiation is available at http://www.epa.gov/radiation/sources/mail_irrad.htm.  The deadline for IUR submissions for calendar year 2005 is December 23, 2006.
