ACC Environmental & Sustainability Committee Legal Quick Hit: Preparing for a New Enforcement Regime in Climate Change Risk Disclosures

In recent months, the battle grounds and legal tools being used to impact climate change policy have evolved.  While the SEC has not taken action since issuing its Climate Risk Disclosure Guidance in 2010, shareholders, activist groups, and attorneys general are pressuring companies to improve disclosures surrounding climate related risks.  This webinar will:

  • discuss what climate change risk disclosures are required under existing law
  • examine the investigative efforts to date of this newly formed “AG’s United for Clean Power”
  • carefully revisit the basic options, responses, and risks involved in responding to subpoenas seeking climate related information, including when challenges may be appropriate or available
