Karen Hansen will be speaking at this BNA Audioconference at 2:00pm on Thursday, June 21st. She will be one of three panelists discussing and exploring critical water law developments and how they may impact future regulatory and legislative actions. 

In a series of recent court decisions, successful challenges have been brought to overturn long-standing Environmental Protection Agency interpretations of key Clean Water Act provisions. Courts have determined the applicability of the National Pollutant Discharge Elimination System program to previously exempt practices, such as pesticide use, water transfers, and ballast water.  Similarly, a court decision finding that wasteload allocations require daily rather than seasonal or annual limits may affect NPDES permitting and the ability of EPA to promote use of its water trading policy.

The panel will also address the June 5, 2007 EPA/Corps of Engineers guidance on the scope of CWA 404 jurisdiction in the aftermath of the Supreme Court's decision in Rapanos v. United States, and the ongoing uncertainties in this area of clean water law. Finally, the panel will discuss how states and Congress are responding to some of these policy areas, further complicating the regulatory landscape.
