Beveridge & Diamond, P.C. represents and counsels clients with respect to commercial real estate litigation and arbitration related to transactional and environmental matters.  Our experience includes:

  • Advised a privately-held development client on an environmental remediation dispute for a mixed-use development project valued in excess of $800 million. 
  • Advised a former owner of a major league sports franchise in several complex real estate-related business disputes involving issues such as breach of fiduciary duty, self-dealing, and other claims.
  • Representing eight affiliated companies in the real estate-related aspects of class action litigation in two states over their respective right to own, develop, manage, and sell their respective properties worth collectively $500 million.
  • Selected by a national labor union’s pension investment fund and a publicly held REIT to arbitrate a ground lease dispute involving 41 acres of improved Northern Virginia property containing over 800 multi-family residential units.
  • Advised a developer in challenges to local refusal to approve construction plans for residential and tourist development after all other necessary permits were granted, including Constitutional challenge heard by the United States Supreme Court on a petition for certiorari.
  • Negotiated a $52 million settlement on behalf of a county government in a major tax and lease dispute with commercial lessees of county-owned real property.
  • Negotiated, as Massachusetts real estate counsel to a national corporation, a multi-million dollar settlement arising from claims of indemnity provisions in recorded deeds.
  • Represented developer in delay and lost profit claim arising from contamination of property discovered during excavation for construction of office building in Washington, D.C. 
  • Represented owner of commercial property in Washington, D.C. arising from purchaser’s failure to settle and its attempt to re-negotiate the purchase price based on the discovery of subsurface contamination during due diligence period.
