Mark Duvall Presenting ACC Webinar on EPA’s TSCA Fees Rule

Beveridge & Diamond Principal Mark Duvall (Washington, DC) will present an Association of Corporate Counsel (ACC) Environmental & Sustainability Network webinar, "Notification and Payment Obligations Under U.S. EPA’s TSCA Fees Rule." The program will take place on Tuesday, March 3 from 1:00 to 2:00 p.m. ET.

In-house counsel may need to alert their companies of a broad-reaching requirement to submit information to the U.S. Environmental Protection Agency (EPA) in March 2020, and to pay a portion of a fee of more than a million dollars to EPA later this year. Under the Toxic Substances Control Act (TSCA), EPA recently designated 20 high-priority substances including 5 phthalates, 3 flame retardants, and formaldehyde. “Manufacturers” of any of these substances over the past five years have until this March 27 to notify EPA that they are manufacturers, so that EPA may later assess them a portion of a fee of $1,350,000 per substance. The catch comes in that, for the first time ever, EPA has not included any exemptions from its requirements. As a result, many companies, including importers of finished products such as electronics or products made with composite wood, may be unaware that they are subject to this upcoming obligation. Mark Duvall will explain who’s covered and outline key action items for companies affected by the TSCA Fees Rule.
