B&D Argues Before Pennsylvania Supreme Court for Right to Farm Act Protection

Principal Jimmy Slaughter (Washington, DC) argued before the Pennsylvania Supreme Court for protection from tort lawsuits for farmers and their contractors under the Pennsylvania Right to Farm Act’s statute of repose. Eleven amici, including the Pennsylvania Attorney General, the City of Philadelphia, and the National Association of Clean Water Agencies, supported Jimmy’s clients in seeking judicial enforcement of a robust Right to Farm Act. In his argument, he noted, “Biosolids are recognized as an agricultural fertilizer under many Pennsylvania and federal laws and regulations. The normal agricultural operation definition in the Right to Farm Act is a very expansive definition that encompasses all manner of agricultural operations. Biosolids and use of bulk organic fertilizer easily qualify under that broad definition.”
