B&D Strengthens NEPA and Project Development Capabilities with Addition of Of Counsel Barbara Marvin
B&D’s NEPA and project development capabilities continue to grow with the addition of Of Counsel Barbara Marvin to our Washington, DC, office. Barbara brings extensive experience in counseling clients on land use issues and facilitating the successful completion of their projects.

Barbara possesses a wealth of knowledge in various areas of law crucial to successful project execution. She is well-versed in the Administrative Procedure Act, the Indian Long Term Leasing Act, the National Historic Preservation Act (NHPA), and the National Environmental Policy Act (NEPA). Her expertise in these statutes allows her to provide comprehensive counsel to clients, and protect their interests throughout the regulatory process.
Before joining B&D, Barbara worked in private practice as a member of the Indian Law and Environment and Energy Practice groups. During this time, she advised companies on NEPA compliance, leveraging her understanding of environmental regulations to help clients effectively navigate their obligations. She also played a vital role in assisting a Tribe in developing a strategy for resolving regulatory and permitting issues under the Clean Water Act.
Barbara was also a staff attorney for the National Indian Gaming Commission. In this role, she worked closely with Tribes and gaming management companies, ensuring strict adherence to the Indian Gaming Regulatory Act. Prior to that, she served as a Trial Attorney for over a decade at the U.S. Department of Justice (DOJ). At DOJ, Barbara successfully defended the United States against breach of trust, environmental, and Fifth Amendment takings claims. Barbara's expertise extended to cases involving tribal recognition, land-into-trust decisions, and water rights.
