Biography

Alex has more than a decade of experience helping clients respond to extended producer responsibility mandates.

When governments consider new extended producer responsibility (EPR) laws, Alex helps clients respond. Before the laws or regulations are adopted, he advocates on behalf of client interests. Once mandates pass, Alex counsels industry groups on the formation and governance of producer responsibility organizations and counsels individual companies on the impact of these laws on their operations. Alex routinely represents clients implementing EPR laws on issues like preparing stewardship plans, understanding the environmental, health, and safety requirements applicable to program operations, and implementing plans through contracts and other required regulatory submissions. His experience includes working with clients in battery, medical device, pharmaceutical, and other industries on EPR mandates and practical compliance solutions. 

Alex also represents clients seeking government authorizations for project or product development in other contexts, including under waste programs, Pennsylvania environmental laws, and the federal Endangered Species Act (ESA). This representation includes planning, permitting, and implementation efforts, as well as related advocacy. 

Representative experience includes: 

  • Advising on the formation and implementation of product stewardship organizations and related product stewardship programs, including negotiating stewardship program approval with government agencies.
  • Representing clients in EPR legislative and regulatory efforts, including drafting EPR legislation and regulations.
  • Counseling clients on the application of EPR laws to their products and operations.
  • Analyzing the management of various pharmaceutical products and medical devices under hazardous waste, medical waste, solid waste, and controlled substance requirements.
  • Drafting and negotiating contracts for medical or other waste management and disposal services.
  • Advising on compliance with various Pennsylvania environmental laws, including hazardous and solid waste requirements.
  • Representing a coalition of energy companies on the development of a habitat conservation plan under the ESA and National Environmental Policy Act (NEPA).
  • Advocating in ESA species listing actions.
  • Member of a B&D team that secured a favorable award in Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) data compensation dispute.

Alex is located near Harrisburg, PA, and practices out of our Washington, DC office.
