As a former U.S. Environmental Protection Agency (EPA) attorney, Tim provided counsel on judicial and administrative enforcement cases and compliance investigations, with a focus on the Clean Air Act (CAA), Clean Water Act (CWA), and Resource Conservation and Recovery Act (RCRA), as well as issues impacting the oil and gas and animal agriculture sectors. At EPA, he litigated enforcement cases, negotiated settlements, led compliance investigations with engineers, and helped develop and implement national enforcement policies that advanced Agency enforcement priorities.

Tim now provides compliance counseling, enforcement defense, and regulatory advocacy for clients in the chemical manufacturing, waste management, mining, telecommunications, data center, and aerospace and defense sectors, among others. He also provides counsel to trade associations, including for administrative litigation matters.

Recent Representative Matters

• Helping a chemical manufacturer obtain a compliance date extension for CAA National Emissions Standards for Hazardous Air Pollutants.
• Providing RCRA compliance and permitting counsel for a waste management company.
• Defending a mine in a CWA judicial enforcement action involving the U.S. Department of Justice and EPA.
• Counseling for a telecommunications company on compliance matters regarding Colorado’s and Denver’s building energy performance standards and benchmarking programs.
• Working with data centers on CAA compliance.
• Providing compliance counsel and regulatory advocacy regarding EPA’s hydrofluorocarbon regulations under the AIM Act for companies in multiple industrial sectors, including aerospace and defense, cooling equipment manufacturing, data centers, and refrigerant reclaiming.
• Providing regulatory advocacy on PFAS matters for a chemical manufacturer.

Oil and Gas Industry Experience

Tim has extensive experience with the oil and gas industry. At EPA, he developed and implemented the Agency’s Oil and Gas Audit Programs and National Enforcement and Compliance Initiative focused on CAA compliance at exploration, production, and processing facilities. Tim also managed EPA’s CAA fuels enforcement program, including enforcement matters related to the Renewable Fuel Standard Program.

• Served as a litigation team member in: U.S. & The State of Colorado v. WES DJ Gathering LLC f/k/a Kerr-McGee Gathering LLC (D. Colo.); U.S. & The State of Colorado v. K.P. Kauffman Company, Inc. (D. Colo.); and U.S. & The State of Colorado v. PDC Energy, Inc. (D. Colo.).
• Provided legal counsel during groundwater investigations of hydraulic fracturing operations in Pavillion, Wyoming; Parker County, Texas; and Dimock, Pennsylvania.
• Led CWA compliance investigations of animal agriculture sector companies.
• Developed and implemented EPA’s Concentrated Animal Feeding Operation (CAFO) National Enforcement Initiative Strategy and Chesapeake Bay CAFO Compliance and Enforcement Strategy.
• Implemented EPA’s Animal Feeding Operations Air Compliance Agreement and National Air Emissions Monitoring Study.
