Navigating EPA’s Unprecedented Efforts to Require Stormwater Permits for Formerly Unregulated Entities and Key Deadlines

During this webinar, B&D Principals and leaders of our Water group, Richard Davis (Washington, DC), Drew Silton (Washington, DC), and Erika Spanton (Seattle, WA), discussed EPA's recent efforts to expand National Pollutant Discharge Elimination System (NPDES) stormwater permitting requirements in Region 1 and Region 9. These unprecedented initiatives impact a wide range of formerly unregulated properties, across three watersheds in Massachusetts (Region 1) and two watersheds in Los Angeles County (Region 9). The speakers explored the legal vulnerabilities and regulatory implications of these expansive stormwater regulation efforts; provide actionable insights for property owners, municipalities, and industry stakeholders; and outline considerations affected entities in Region 1 should make ahead of the January 29, 2025 comment deadline.  

This webinar is geared toward legal and business leaders at companies with commercial, industrial, and institutional (CII) properties in Region 1 and Region 9, but these developments, if unchallenged, are likely to have nationwide implications by setting a precedent for other EPA Regions and authorized states. CII properties include shopping centers; industrial facilities not currently required to hold NPDES stormwater permits, such as many pharmaceutical, telecommunication, and semiconductor manufacturing operations; administrative office areas, employee parking lots, and other non-industrial portions of currently regulated industrial facilities; landside areas of airports; hospitals and other health care facilities; colleges, universities, and community colleges; public schools; automobile race tracks; and utility-scale solar sites.
