Tap draws on his years of government experience to identify and mitigate compliance risks, advise on regulatory issues, and resolve problems when they arise. A life-long Maryland resident, Tap maintains strong relationships with the state’s business community and frequently represents them before the Maryland Department of the Environment and its agencies. Tap litigates complex civil disputes, including enforcement defense matters, citizen suits, and mass tort actions. Leveraging his deep understanding of federal and state government processes, Tap guides clients through nuanced questions of environmental law.

At Beveridge & Diamond, Tap has successfully handled a range of complex environmental and commercial litigation matters, including those related to per- and poly-fluoroalkyl (PFAS) substances, the Clean Water Act (CWA), and business tort claims. He also advises clients on state-level compliance and regulatory requirements, including energy performance standards and storage tank regulations. In addition, Tap counsels clients on contaminated site matters under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), supporting clients through all phases from investigations, feasibility studies, design, implementation, dispute resolution, and cost recovery.

Before joining the firm, Tap served as a Trial Attorney in the Environmental Enforcement Section of the U.S. Department of Justice (DOJ)’s Environment & Natural Resources Division. There, he handled matters arising under the major environmental pollution statutes. He led civil enforcement case teams in Clean Air Act (CAA) matters involving natural gas processing, chemical manufacturing, and aftermarket auto parts. He negotiated and drafted consent decrees under both the CAA and CWA, involving detailed injunctive relief packages, mitigation, and Supplemental Environmental Projects (SEPs), and enforced stormwater and industrial wastewater permit requirements under the CWA. At DOJ, Tap obtained a deep understanding of CERCLA, securing substantial cost recoveries related to hard-rock mines, landfills, and lead-contaminated residential properties. He further handled cost recovery matters under the U.S. Army Corps of Engineers’ Formerly Utilized Sites Remedial Action Program (FUSRAP), a federal program addressing legacy radiological contamination, strengthening his experience with complex federal remediation and allocation disputes.
