Representative Matters

At B&D, Tap has successfully litigated numerous matters on behalf of his clients. His experience includes:

  • Secured dismissal of a lawsuit challenging the U.S. Environmental Protection Agency’s (EPA) decisions regarding the study and regulation of PFAS in biosolids on behalf of the National Association of Clean Water Agencies (NACWA) NACWA was a Defendant Intervenor in the case on the side of EPA.
  • Successfully persuaded federal regulators to address an additional area of an industrial site under a settlement agreement requiring the federal government to share response costs.
  • Secured the dismissal of a Clean Water Act (CWA) citizen suit alleging unpermitted discharges of PFAS
  • Negotiated an administrative settlement with state regulators resolving alleged violations of underground storage tank requirements.
  • Secured dismissal of a business tort lawsuit on behalf of a non-profit against a much larger and better-funded opponent regarding Maryland’s above- and underground storage tank requirements.

Prior to joining B&D, Tap served as a Trial Attorney in the Environmental Enforcement Section of the U.S. Department of Justice (DOJ)’s Environment & Natural Resources Division. His previous experience includes:

  • Leading civil enforcement case teams in Clean Air Act (CAA) matters involving natural gas processing, chemical manufacturing, and aftermarket auto parts.
  • Negotiating and drafting consent decrees under both the CAA and CWA, involving detailed injunctive relief packages, mitigation, and Supplemental Environmental Projects (SEPs).
  • Enforcing stormwater and industrial wastewater permit requirements under the CWA.
  • Securing substantial cost recoveries under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) in a wide variety of contexts, including hard-rock mines, landfills, and lead-contaminated residential properties.
  • Handling cost recovery matters under the U.S. Army Corps of Engineers’ Formerly Utilized Sites Remedial Action Program (FUSRAP), a federal program addressing legacy radiological contamination, strengthening his experience with complex federal remediation and allocation disputes.
