James Auslander is an associate in the Washington, D.C. office of Beveridge & Diamond, P.C., with a general environmental, litigation, and regulatory practice. The primary focus of his practice involves environmental due diligence and litigation, regulatory compliance, permitting, and administrative law. Mr. Auslander has represented individual businesses, trade associations and state agencies in compliance, enforcement, and counseling matters involving the Clean Air Act, NEPA, CERCLA, APA, and other federal environmental laws as well as state programs. For example, he has drafted comments to EPA regarding proposed regulations on particulate matter on behalf of a major trade association; performed environmental due diligence for a major transportation project; assisted in the preparation and settlement stages of litigation involving enforcement actions, challenges to agency decisions, and toxic tort claims; and prepared a contract for the removal and final placement of contaminated soil as part of an overall CERCLA site remediation. In addition, Mr. Auslander is well-versed in various issues involving the Endangered Species Act, SMCRA, Data Quality Act, federal takings law, and biosolids as well as a range of international laws and treaties, particularly involving regulation of the transportation of hazardous waste. He also maintains a steady pro bono practice involving special education issues, estate planning, and teaching environmental law to elementary schoolchildren. Mr. Auslander received his legal degree from Harvard Law School (J.D., 2005) and his undergraduate degrees in Public Policy Studies and Economics, as well as a Certificate in Health Policy, from Duke University (B.A., magna cum laude, 2002). While attending Harvard, Mr. Auslander served as President of the Harvard Environmental Law Society (2003-04) and Line Editor on the Harvard Environmental Law Review. Mr. Auslander previously worked as a law clerk in the Environmental and Natural Resources Division, Law and Policy Section, of the U.S. Department of Justice, and as policy intern in the Director's office of the U.S. Export-Import Bank, focusing on international environmental policy. He is a member of the District of Columbia Bar, the New York Bar and the New Jersey Bar.
