B&D Litigators Secure Victories in Two of Law360’s Top 3 Environmental Cases of 2025

Law360

In its roundup of the Biggest Energy & Environmental Court Decisions Of 2025, Law360 ranked two B&D victories in its top three environmental cases of the year: City and County of San Francisco v. U.S. Environmental Protection Agency and New York et al. v. Donald Trump et al. B&D is proud to have helped our clients achieve these precedent-setting outcomes and looks forward to helping our clients navigate the evolving legal landscape in 2026.

Summarizing San Francisco v. EPA, Law360 explained how the Court rejected EPA’s attempt to impose “certain provisions of a Clean Water Act permit that were too vague for the city to comply with.” The Court held that EPA must instead clearly define the restrictions permittees must meet to protect water quality. Principal and Co-Chair of B&D’s Water practice, Drew Silton led this matter. In addition to Drew, the B&D team on this case included Principals John Cruden and Richard Davis, and Paralegal Laura Milano. Coverage of the high court’s opinion can be found in the New York TimesWashington PostAssociated PressNational Law JournalInside EPA, and Law360, among other media outlets.

In New York et al. v. Donald Trump et al., the U.S. District Court for the District of Massachusetts ruled in favor of a leading wind industry trade association in litigation challenging the federal government’s suspension of new and renewed permits for onshore and offshore wind projects.  In this expedited, multi-phase litigation, B&D provided strategic and legal guidance from case development through summary judgment, working closely with state plaintiffs, industry stakeholders, and amici to present a unified approach. Under the leadership of Principals Jamie Auslander and Brook Detterman and Of Counsel Justin Smith, the team also included Principals Hilary Jacobs, Julius Redd, and Peter Schaumberg; Associates Nick Hanel and Jesse Miles; and Paralegals Viktor Podolsky and Jackie Bennett-Vroman.

Looking ahead to 2026, B&D stands ready to help clients navigate issues with significant legal, regulatory, and business ramifications.
