Erika Spanton, Jack Zietman to Present on the Future of the Chevron Doctrine & WOTUS for the Association of Corporate Counsel

Erika Spanton (Principal, Seattle) and Jack Zietman (Associate, Washington, DC) will present an Association of Corporate Counsel (ACC) Environmental & Sustainability Network Legal Update webinar, "Putting the Court to the Test: The Future of the Chevron Doctrine & Post-Sackett WOTUS Designations."

The Supreme Court has recently pulled two critical legal tests into the spotlight. At the end of May, the Supreme Court ruled in Sackett v. EPA that the long-established “significant nexus” test could no longer be used to determine the scope of federal Clean Water Act jurisdiction over waters of the United States. Next term, the Court has agreed to hear a group of New Jersey herring fishers’ challenge to a key administrative law doctrine—the “Chevron doctrine,” a two-part legal test to determine whether a federal court should defer to a government agency’s interpretation of a statute that it administers, and which has been heavily cited in the past 40 years. Without Chevron, courts will likely revert to case-by-case decision-making, which could limit or question federal regulations affecting every sector of the national economy. Our speakers will discuss the outcome and ramifications of Sackett, the history of the Chevron doctrine, the next Supreme Court term’s pivotal case, and potential outcomes for environmental regulations and administrative law.
